Terms and Conditions

1. APPLICATION 

1.1 These terms and conditions ("T&Cs") apply to your registration for any  programme offered by the Pāmu Academy (“Programme”) and your use of this website (the "Website"). By registering for a Programme and/or using this Website, you are deemed to accept these T&Cs and are bound by them. 

2. REGISTRATION FOR PROGRAMMES 

2.1 By registering for one of our Programmes, you agree that: 

(a) Submission of a registration form for a Programme (online, email or mail) is deemed to be a binding contract between you and the Pāmu Academy for attendance at the Programme nominated on the registration form. 

(b) Payment in full is required so secure your place on the Programme. If payment has not been received in full you will not be entitled to attend the Programme. We take Visa, MasterCard or Amex, or you can pay by direct deposit. 

(c) Pāmu Academy requires a minimum number of participants to proceed with any Programme. The minimum number is set out on the Website for the different Programmes. If we are unable to obtain the minimum number to make hosting the Programme viable, we will advise you and you will have the option of registering for another Programme or receiving a full refund. 

(d) We may use your contact details to contact you in relation to Programme updates, other Programmes you may be interested in, and Pāmu Academy promotional purposes. You may unsubscribe from this at any time. 

(e) If you consent to the use of photographs and/or video being taken of you (an election on your Programme registration from) you agree that the Pāmu Academy has the right and permission, indefinitely, to copyright and use, reuse, publish and republish photographic or video images of you in whole or in part for Pāmu Academy promotional purposes. You agree that you waive any right that you may have to inspect or approve any use of your image. 

3. PROGRAMME CANCELLATION 

3.1 Should you be unable to attend the Programme you have registered for, the Pāmu Academy will accept a substitute attendee from the same organisation. Notification of the attendee change must be provide at least 24 hours prior to the Programme commencing. 

3.2 If you are unable to attend the Programme for any reason and cannot find a substitute attendee you are not entitled to a credit or refund. 

3.3 We reserve the right to cancel a Programme prior to its commencement for any reason (for example, the unavailability of Programme facilitators). In all such cases, Pāmu Academy will notify Page 2 

you and give you the option of registering for an alternative Programme or receiving a full refund. Pāmu Academy is not liable to you for any other costs or losses incurred by you in relation to the cancelled Programme. 

4. USE OF WEBSITE 

4.1 The information on this Website is general information only, is provided free of charge and does not constitute legal or other professional advice. We try to keep the information up to date, however provide no warranty, express or implied, as to accuracy, completeness and fitness for any particular purpose. 

4.2 You agree to use the Website in a manner that complies with all applicable laws and regulations and that does not infringe our rights, nor the rights of anyone else. 

5. INTELLECTUAL PROPERTY RIGHTS 

5.1 We (or our licensors) own all intellectual property rights in the Website, including all of the content and all software code underlying and forming part of the Website, and all content provided in connection with any Programme. 

5.2 You may use information received in connection with any Programme or from our Website on a non-exclusive, non-transferable basis for your or your company/organisation’s own use. Otherwise you must not copy, display, modify, reproduce, store in a retrieval system, transmit (in any form or by any means), distribute, use for creating derivative works or use in any other way for commercial or public purposes any part of this Website or Programme content without our prior written consent. 

6. LIABILITY 

6.1 To the maximum extent permitted by law, we will not be liable to you for any damages, losses, costs or expenses of any kind which arise out of, or result from, any use of, or inability to use, this Website or any information provided in connection with any Programme. 

6.2 You agree to indemnify and keep indemnified us from and against all actions, claims, costs (including legal costs and expenses), losses, proceedings, damages, liabilities, or demands suffered or incurred by us to any person arising out of or in connection with your failure to comply with these T&Cs including, in particular, clause 5. 

7. GENERAL 

7.1 We may amend these T&Cs in whole or in part from time to time. Amendments will be effective immediately when we post the amended T&Cs to the Website. You are responsible for ensuring you are familiar with the latest T&Cs. By continuing to use the site following any amendments, you agree to be bound to the T&Cs as amended, whether or not you have been notified of any amendments. 

7.2 The Website and these T&Cs is governed by the laws of New Zealand. When you access the website, you submit to the non-exclusive jurisdiction of the New Zealand courts.
